1. Who is responsible for your data

The controller of your personal data and the provider of this website is:

MARIUSZ SAJA, sole trader (autónomo, registered in Spain) trading as ONLINE SMART MARKETING
Spanish tax number (NIF): ES Z2991902K
Address: Calle Rubi-Pau 2, 8 Piso PB Puerta 55, 03189 Orihuela Costa, Spain

This policy explains how I handle personal data under the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018 and the Privacy and Electronic Communications Regulations (PECR). For anything about your personal data, write to the email address above.

2. What data I collect, why, and how long I keep it

Email and phone enquiries

When you write to me or call, I process the details you give me (name, email address, phone number and the content of your message) so that I can reply. Lawful basis: steps taken at your request before entering into a contract (Article 6(1)(b) UK GDPR) or my legitimate interest in answering correspondence (Article 6(1)(f) UK GDPR). I keep this data until the matter is closed and then for as long as any related claim could arise.

Booking a call

When you book a call using the form on this website, I process the details from the form (name, email address, phone number, the time you choose and any information about your business you enter) to arrange and hold the call. Lawful basis: steps taken before entering into a contract (Article 6(1)(b) UK GDPR). I keep this data until the call has taken place and a decision about working together has been made; if we do not go ahead, for no longer than 12 months.

Working together and invoicing

If you become a client, I process the data needed to perform the contract and issue invoices. Lawful basis: performance of a contract (Article 6(1)(b) UK GDPR) and my legal obligations in tax and accounting (Article 6(1)(c) UK GDPR). My business is registered in Spain, so accounting records are kept for the periods required by Spanish tax and commercial law.

Visitor statistics — Google Analytics

Only if you agree in the cookie banner, this website uses Google Analytics 4 to see which pages are read and where visitors come from. The provider is Google Ireland Limited. Lawful basis: your consent (Article 6(1)(a) UK GDPR and regulation 6 PECR), which you can withdraw at any time in the consent settings on this website. Statistics are kept in Google Analytics for 14 months. Google may transfer data to the United States; Google LLC is certified under the UK Extension to the EU-US Data Privacy Framework (the “UK-US data bridge”), which the UK Government recognises as providing adequate protection.

YouTube videos

Some pages contain videos from YouTube (Google Ireland Limited). A video only loads once you consent to it — YouTube may then set cookies and receive your IP address. Lawful basis: your consent (Article 6(1)(a) UK GDPR and regulation 6 PECR).

Running and securing the website

The web server automatically records technical data (IP address, browser type, time of visit, address visited) so that the website works and is protected against attacks. Lawful basis: my legitimate interest (Article 6(1)(f) UK GDPR). This data is deleted after a short period unless it is needed to investigate an incident.

3. Who I share data with

Data may only go to companies that help me run this website and my business: my hosting and email provider, the provider of the booking tool, Google (Analytics and YouTube — only with your consent) and the people who handle my accounting. I do not sell personal data or share it for advertising.

My business and my hosting provider are located in the European Union. The UK recognises the European Economic Area as providing an adequate level of data protection, so no additional safeguards are needed for data sent there from the UK.

4. Your rights

You have the right to access your data, to have it corrected or erased, to restrict its processing, to data portability, to object to processing based on legitimate interest, and to withdraw your consent at any time (withdrawal does not affect anything done on the basis of consent before then). To use any of these rights, write to info@onlinesmartmarketing.com — I will reply within one month.

You can also complain to the UK supervisory authority, the Information Commissioner’s Office (ICO), at ico.org.uk/make-a-complaint or on 0303 123 1113. As my business is established in Spain, you may also complain to the Spanish authority, the Agencia Española de Protección de Datos (www.aepd.es).

5. Do you have to give me your data?

Giving your data is voluntary. Without it, however, I cannot reply to your message, arrange a call or enter into a contract with you. I do not make decisions about you based solely on automated processing and I do not profile you.

6. Cookies

This website uses cookies that are strictly necessary for it to work; statistics cookies and third-party content are used only with your consent. Details, the list of cookies and how to change your consent: Cookie Policy (UK).
